Rule 43 judgment from the Bloemfontein High Court in which Jordaan AJ states that the purpose of a Rule 43 application is to provide a streamlined and inexpensive procedure for procuring interim relief in matrimonial actions, and the proceedings are not intended to give an ‘interim meal ticket’ to applicants who won’t be able to establish a claim for maintenance at the trial.
In this matter the applicant was a qualified teacher but was unemployed and suffered from bipolar disorder and postpartum depression. The respondent was awarded primary residence of the children, and was ordered to pay maintenance in the amount of R8 000-00 per month to the applicant and a cost contribution of R10 000-00.
